Mississippi regulators say three SpaceXAI data center sites began construction without required stormwater permits, exposing the company to potential penalties of up to $6.1 million.
The Mississippi Department of Environmental Quality issued an enforcement notice to MZX Tech LLC, a SpaceXAI subsidiary. Regulators are seeking penalties of up to $25,000 per day. The alleged violations were disclosed in a filing to the Securities and Exchange Commission.
The sites are Macrohard and Macroharder, which are operational, and Minihard, where construction is continuing. The facilities are in Mississippi but support operations around Memphis, Tennessee. SpaceXAI said it is cooperating with state officials and discussing a possible settlement covering all three locations. No final settlement terms have been disclosed.
Separately, the NAACP is suing over gas turbines at SpaceXAI’s Southaven facility, alleging the company built and operated them without required environmental permits. The organization is seeking penalties and an injunction restricting turbine operations. A federal judge rejected the government’s bid to dismiss the case, allowing it to continue without deciding whether the alleged violations occurred.
